Strange call from the Police today!!!

From a legal standpoint, and I have been on both sides of the law.
Technically the vehicle is not yours.
I ran into this situation once before about 6 years ago where a so called friend of mine called me and asked me if I would haul a vehicle home for him with my race car trailer.
Now I knew this person since Kindergarten and I knew that he was a doper and I also knew that there was something more then what he was telling.
I came to find out that his daughter was using the vehicle and she did a dope deal down in Pittsburgh and the police knew that she was hauling dope in the vehicle and chased her and the dope was still in the vehicle.
Anyone that moved the vehicle would have been just as guilty of possession of narcotic's as the person who originally operated the vehicle.
Now think about it like this, the only person in the world who would go out and buy a pimp mobile and then not register it would be a dope dealer.
He needed a clean vehicle where he could haul his dope and it was not to his benefit to register it in his name. Even if he said that you lent it to him, you would still be liable - because it was used to commit a felony.
Just the same as if he robbed a bank or held up a liqueur store or killed someone.
The very first thing I would do - before I did anything else would be to call a lawyer and find out what the legal ramifications were before I went out there all fat, dumb and happy. You don't just get something for nothing.
I smell a trap and a rat and the cheese is Limburger.

This is a good point.

Just a question though, can he really be held liable if there was no intent or knowledge of what the vehicle was going to be used for? I mean, when thinking about filling out the four essential elements of a crime, it doesn't really fit.

For drugs, possession is 9/10ths. Enough to get you arrested, charged, and in jail. Eventually you could probably make the case that you had no knowledge, but it would be a hard sell. For all you know, the locked up owner might be offered immunity in exchange for testifying that the vehicle was yours, and so were the drugs... would it be a lie? Sure. Can you PROVE that your papers are not just a cover story? That you are not a drug dealer (hint, can't prove a negative)?

Personally? I wouldn't touch it.
If you do, please ask the officers to bring in a drug dog and check it out, since you are concerned that if the buyer never registered it, that it may have been used in commission of a felony or for the transportation of drugs.


Sounds like the guy took it, never registered it (warrants? child support? suspended license?) and then got caught Drunk driving on a golf course. It could be more nefarious though.


If you think for a minute, it isn't your truck. You already got paid for it. What happens to it now is between Criminal and the Police department. If dude was dumb enough to not even get his GF to register it, he deserves to lose it to auction, and do you really want it back at this point?
Best if you stay away from it, the bad karma, and the expenses of owning a wrecked and abused (and possibly title contested) vehicle.

Good valid points from all of you. I got some pics, they are a bit grainey (sp) but here they are.

Waiting for an answer from the lawyer. The detective says it wasn't used in anything illicit, no trace of anything illegal. The buyer was picked up on New Years after an altercation in Las Vegas where someone enbeded up fatally beaten and he's the main suspect...

That things pretty beaten up. I wouldn't be surprised if he was used for something illegal. Almost seems like the dude was in a car chase or something.

Jeebus....what the hell were they doing to screw up the lower doors so bad? People are f'n nuts.....

I would work to "legally" get the vehicle back in your name....part out what you can, and then maybe get a salvage title for it... Someone would probably be willing to take it off your hands for a little bit of cash as a project or a fixer upper...

Just be careful...don't want anything to come back and bite you in the ass...

Yeah I know I would be upset looking at something I spent hard work fixing up being in that shape. Still if there were no legal ramifications I would want that thing back even in that shape. I know there would be several members here dying for a ton of those parts. Plus you would have your SC back!

Damn man. Seeing he is a suspect in a fatal beating, I'm sure he won't be roaming the streets anytime soon. Going the legal route, get the Hoe back to AZ, assess the damage, rebuild it or part it out..

Alright, I got a go ahead from the lawyer and I'm gonna drive up there to check it out... I did try to speak with the other party but they don't have time for me right now and could care less. **** it!! They don't care, I have a power of attorney in hand and documentation to either bring it down or just sign it over to them and they can do with it what they please..

This kinda happened to me with a bmw i sold.. and i got it back legally.. couldnt find the owner.. and was still reg to me.. i got it back in better condition than i sold it.. and sold it again.. so i made like $12,000 off of a $6,000 car.. lol

im pretty sure the person who bought it will come back to claim it. he did paid a shit load of money. he could take you to court and end up just paying for what ever it is you paid for to get it towed/bonded. if he has a bill of sale and title signed by you its enough proof you sold him the truck.

Nope.. tow it home.. put a lien on him for the towing bill.. wait thirty days.. and its yours.. even if you didnt have the title.. so there you have title in hand and a legal upper hand if something DID happen.

Im not saying **** the dude.. but.. he has been driving on YOUR registar the whole time.. if he would have killed them in YOUR shit.. you could be held liable.. so i mean.. ... ... .....
