Just my opinion but I can't believe your insurance just didn't total the vehicle and give you a check. Most insurance companies look at what the Blue Book value of the vehicle is and compare that number to the cost of getting it fixed and go from there. Vehicle is worth $10K and it's going to cost $15K to repair it...just total it and give you the check for what its worth and move on. Certain damage is an immediate write off, such as if the windscreen side or support brackets are damaged...instant write off. They can never be repaired so a factory or new windscreen will fit and not eventually crack or leak. Which is good to know as if you wanted to total your ride...get a baseball bat or steel rod...those pesky vandals do some pretty rotten shit don't they!
As for your personal injury and time lost...SEE A LAWYER! The insurance company will low ball you every time. It's their job to get off with giving you the lesser amount and closing the case. Most back injuries are lingering and never really go away and you end up in physical therapy for quite a while. A lawyer, blood suckers that they are, are good at making the insurance company live up to the terms of the policy...and then some.
One note is that when your vehicle is totaled the insurance company takes possession of the vehicle. They turn around and sell it to a scrapyard for pennies on the dollar or sell it at an insurer's auction. If you want the vehicle back you can always go to the 'yard or auction and buy it back. The insurance company doesn't care as long as they recoup some, if not all, of their money. Sometimes parts, sold separately, are worth more than the intact vehicle.
