What would you do? Dealer negligent on warranty repair, now out of warranty and out $1675

The first dealership isnt going to write him a check for missing something. He'd have better luck working with 2nd dealership that work was completed and he paid.

Both dealerships are listed on my complaint ticket to GM corporate, and I will give them the 2 business days response time.

If they don't refund, then the gloves come off.

EPA fine alone is $37500 for knowingly refilling a leaking system.

BBB complaint, endless negative online reviews, I have time and persistence.

Probably can reverse the Visa card payment as well, those take awhile for dealership to answer my dispute.

2 days from now and I should know something.

Stick with corporate. They have done this before. Your one " winning argument" is Dimmwit's failure to properly service the freon. ( I can imagine Dimmwit has a history & corporate knows)

May I suggest what I did..... Get a respectable certified shop to 'advise' of the dealer's work and have them do a "second opinion" in writing. Submit it with original dealer paperwork to GM.

May I suggest what I did..... Get a respectable certified shop to 'advise' of the dealer's work and have them do a "second opinion" in writing. Submit it with original dealer paperwork to GM.



I may do this , thanks for the tip!

My advice, from personal experience, is this: post a negative review with your experience at the dealership to Facebook. Try to tag GM in the post. Also be sure to contact general motors directly with your complaint.

They helped me out several years ago when I took my Yukon in with an out if warranty transmission repair. A repair that caused a new leak once completed and the dealership wanted me to pay them again to open the transmission to fix the problem they created. Good luck!

Thanks! Sounds like a plan, I am giving GM corporate until end of day tomorrow, then if no satisfaction, I am going to start the online bad reviews. Playing semi-nice until tomorrow.

Visa won’t chargeback your payment unless they hear the repair was not completed contractually. If you inform Visa within the designated time frame to dispute charges, the only recourse you’ll have is to dispute the charge as ...

Returned to dealer for covered warranty repair within the one year Mfgr warranty, was told you had to pay for a factory covered (new) repair or your vehicle would be held hostage until u paid.

When filling out the Visa dispute online or mailing it in, you must take screen shots of what you’ve written before you send it in. In other words, compose your dispute in a Word document and save it before you hit send on Visa’s online portal.

The Visa dispute will not send a copy of what you composed in a verification email. Sometimes after you compose your dispute in an online portal, they time out and destroy what you just composed. They only stay active for 10 minutes.

Lastly if you outwit the Visa portal and actually save your work by screen shotting every page that comes up, Visa will not contact you and let the dispute go inactive. Make sure you have a dispute Ref number, the date, time, name of Visa Rep and a confirm # of the initial call u made. It’s typical they’ll claim they have no knowledge of you contacting them and ask you to resubmit all your paperwork.

I had a much more clear cut situation - and was very polite with GM - and they were very "nice" with me - BUT - nothing worked because even when an arrangement was made, the dealer would not cooperate. They would not even give me the parts for me to do cam, lifters, headwork, fluids, gaskets myself!
My issue was an AFM situation where dealer didn't follow TSB change and new program needed for PPV's. In reality GM was not even at fault, since dealer ignored TSB. But that dealer sold (or was forced) out, so new management wouldn't budge. GM even offered an unreal deal on a new one, but dealer refused to "execute" by locating a "Brass hat demo PPV" because they were afraid, maybe I would not want it-despite offering payment in full for the greatly reduced price - and a 100,000 mile warranty - in advance.
I had to revert to the Courts-AND IT WORKED OUT BETTER THAN GREAT (not allowed to disclose $$ number :)) The truth prevails.
YOUR ISSUE IS SIMILAR, AN INCOMPETENT DEALER - NOT EVN GM!!

Find a lawyer who is "into" cars!! They will understand you and enjoy the case-and get good results.
You may be settled after a letter (on lawyer's letterhead) to dealership and copy to GM and maybe EPA.

I intend to take it up to the State level, EPA, small claims court, Florida Attorney General, etc. "Polite" ends at close of business today.

After 23 years in Real Estate and Mortgages (last 11 spent working with ALL the major Lenders , working with foreclosed owners and then dealing with countless evictions, local sheriffs, opposing attorneys, code enforcement, permitting, etc) I know a LOT of options that I can take to make Dimmitt Chevrolet miserable.

Had a pool contractor walk off the job with $2500,and after I was done with him, he's out of business, had to pay me and another customer back their deposit, and got a fine and ban from being licensed in Florida for pool work, and spent a nice weekend in the Big House. Turns out he was not licensed in my county, so even after performing some work before walking off my jobsite, he paid back every nickel AND a nice hefty fine. So I hope for both dealers and GM, that this is handled. (Small Claims court is $275 to file a case, just Dimmit's attorney fees will exceed my $1675, and judges definitely frown on dealers preying on consumers) Attorney General and EPA will be their worst nightmare.

State Licensing Board will probably drop in for a compliance audit, hope all their trade-in titles are in order(they won't be, I worked a few years selling used cars, lol)

Whatever the end result is, Dimmitt Chevrolet will be out far more than $1675, on top of BBB, Yelp, Facebook, and every other negative review that is humanly possible.

Hiring a lawyer is probably the worst possible outcome for Dimmitt, if I go that route, I will be relentless.

Hell, based on GM knowing the AC's are faulty and extending the warranty to 5/60, might even be an interesting case to present to a Class-action law firm I know in Tampa Bay. THAT would really be interesting. And free to me to be the Plaintiff.

Back in 1992, having warranty problems with my '88 truck, AND was frustrated with the 3 nearby GMC dealers ( So Calif), then after , I ran into an off-road racer, who lived & owned a Chevy dealership in Parker Arizona. He told me he "Would have fixed everything and gave me my truck back in a week - He was PISSED at the dealers in California .....

The problem was a combination of the GM rep & the jerk dealers in So Cal.

You can "shop around" / find someone who works at another dealer farther away from the ass hole GM rep in that area.

(((( I also looked for a warranty law firm...... I can bet your problem isn't worth their money / time....... Unless someone died. ( I gave up on warranty law firms )

And, my defects started during my warranty period!!

It's called "Breach of Contract"..... That's the sue-angle $$

Law firms advertise to "be for the people", but they only care about their wallet.

My other warranty period problem was my oil filter leaked at the contact surface. ( Oil adapter - I had an OEM oil cooler )

Dealer blamed the Fram filter. I was at an NHRA race..... Fram had a tent.... Next to a GMC tent..... ( " Perfect" )...... I brought a Fram guy over to a GMC guy.....

They both laughed.....
I changed my oil filter... I then noticed the surface that the filter 'O' ring seated, WAS NOT MACHINED. I got the dealer to at least change that!!

I'm ok with GM doing the right thing, hell, I grew up in Detroit, 28 years up there.

But compared to my last 2 Toyotas, which I did nothing except change the oil and brakes, etc, GM should be better quality, for 60k+ trucks.

I'm still dealing with the windshield washer nozzle issues, this will be service #4 on those, minor but annoying as hell.

AC just ticks me off, knowing that Dimmitt Chevrolet gave up on finding the leak, and now think I am going to just bend over and take it.

They are in for a few surprises now .

Be prepared for the reality that many government agencies will " take note" of an issue, and then thank you for contacting them about your "issue".

Now, to get a government agency to act on a problem? Good luck finding one of them.

They get paid a salary. It doesn't matter if they accomplish anything during the week. They still get paid one way or another. They don't do more than what they have to do. They are a member of a union.

Florida is pretty consumer oriented, probably due to "being a Sunny place for Shady people"

So we'll see, worst case is I take it to small claims court, and any legal fees beyond that I can write off , as I am self-employed. So whatever, as long as it costs Dimmitt customers and/or my $$$, it's a win for me.

GM rep said by Tuesday the dealership may make me an offer, if not then I keep the pressure on.

Plus if I save ONE member of the this forum from going through the same thing with Dimmitt Chevrolet, then it's all good.

Their Facebook page took a bit of a beating today, that's for sure.
