after months of trouble shooting the issue, the mechanic confirmed that it was the transfer case control module or tccm, He informed me that he 'borrowed' it from another car he's been working on and it eliminated the issue completely and he test drove it for a day and the issue was actually fixed.
So my next step is to try to figure out why it broke and hope to fix it otherwise i'll need to squeeze about 250+ USD to replace it with a reman. I will update this post once I actually fix it for real or find it in a junk yard
Good luck

edit: this is what i need to replace to fix my issue apparently....

Hey Man,
I have the EXACT same problem!!! Is your truck still going strong??? The Dealer gave me my truck back after replacing the 4wd actuator said "its fixed" and after a couple of weeks BAM same problem... I am so glad you figured it out!! Great Job..
