yes but can be restored to stock if requested, warranty in tact. It was purchased at apple. It is an itouch not iphone if thats what ur wondering

You can jailbreak an ipod touch but you cannot unlock it. "Unlock" means you can use any carrier on the device... no carrier on ipod touch
