Sounds like your accident was very similar to mine, and I'm also dealing with Progressive (other party).

So far the Progressive rep called and sent me a letter stating that there is no evidence of DV. I had a 3rd party DV assessment which reported several thousand in DV. My attorney drafted a "Demand Letter" which I sent certified mail to the Progressive rep. The letter basically said respond within 30 days or we'll file a claim in circuit court. They signed for the letter this last Friday so I should know more within the next 4 weeks.

Stay tuned....

In other news the repairs turned out great.

Thanks - much appreciated. What possible grounds did Progressive have to justify that there is no DV? It is a shame that you have to get a lawyer involved for something so obvious.

Ironically, I too got rear-ended earlier this month by a Millennial who was insured by Progressive. The Progressive agent first asked if my insurance company was going to pay for repairs:rolleyes: Then stated that I had to prove that the vehicle was diminished in value as a result of being rear-ended. I went to KBB and calculated two value's with the only variable changing being a prior repair, and the difference was about $4.5K. I plan on asking my Chevy dealer for a written valuation at my next service. USAA, my insurer, said they utilize a DV form, which I will borrow. Please do let me know how it goes with your DV claim, and what you did.

In my accident, I was on the freeway in the fast lane going about 60mph in moderate traffic. Traffic came to a gradual stop. I was at a stand-still for about 5-10 seconds when the Millennial plowed into my tow hitch. Swears she was not on the phone:rolleyes:
If need be, get an attorney to ask for her phone records...or at least threaten to do so.

Ha, yeah I laughed when the Progressive rep called and said they did not believe any DV existed. What's crazy is that they obviously tell this to lots of people who just accept it.

Thankfully I've got an attorney who handles this sort of stuff all the time.
